Presale Terms — Founders Batch

Effective: ongoing during reservation mode. Mode B (paid preorder) opens only after owner-approved pricing, MOQ, ship window, and refund terms are published.

1. What "reservation" means

A reservation is a non-binding, no-cost expression of interest. You are not being charged, and Bacorn is not obligated to deliver product to you until (a) the batch minimum production quantity is reached, (b) Mode B opens with published pricing and terms, and (c) you affirmatively convert your reservation to a paid preorder.

2. Batch minimum

Founders Batch #1 has a minimum production quantity target published on the home page and shop page ("Target: N bags"). If total paid preorders reach the minimum by the deadline, we proceed to production. If not, all paid preorders are refunded in full and reservations expire.

3. Presale deadline and ship window

The presale deadline and the estimated production + ship window are published as tracker facts on the home and shop pages. Both are set by the owner in the site's admin config and are visible to you before you convert to paid preorder. If those values change materially before your paid preorder, you will be notified and offered a full refund at your option.

4. Payment and refunds (Mode B — paid preorder)

Payment is processed by Stripe. Refunds are permitted under any of the following:

• The batch minimum is not reached by the deadline (automatic refund).
• The ship window is delayed by more than 30 days beyond the published window (refund on request).
• Material change to the product (final ingredient statement, allergen change, or format change) before shipment (refund on request).
• Discretionary refund on request before the batch enters production (subject to timing).

Where Stripe supports automatic refunds for the applicable payment method, refunds are automatic; otherwise a manual refund workflow will be initiated and an alert sent to Bacorn admin. Refunds return to the original payment method within 5-10 business days from initiation.

5. Cancellation of your reservation or preorder

You can cancel a free reservation at any time via the link in your reservation email or by emailing hello@bacorn.store. Paid preorder cancellations are governed by the refund rules above.

6. What we won't do

• Fake countdowns, invented inventory scarcity, or artificial urgency.
• Charge you before Mode B opens with published pricing and terms.
• Ship product before final formulation, allergen labeling, and shelf-life review are complete.
• Substitute a materially different product without offering a full refund.

7. Product claims and labeling

Nutrition, allergen, shelf-life, water activity, and net-weight information will be finalized on packaging before any paid orders ship. Marketing statements that appear on this site (e.g. positioning language about "smoky", "crunchy", or "comfort snack") are qualitative descriptions and are not nutrition or health claims.

8. Compliance with laws

Bacorn will comply with FDA labeling requirements, applicable state cottage-food / commercial-kitchen rules for the production location, and product liability insurance requirements before Mode B opens.

9. Governing law

These Presale Terms are governed by the laws of the State of Texas, and any dispute will be resolved in Harris County, Texas, unless a mandatory arbitration or class-action-waiver clause is added in the finalized draft with counsel.
